Samuel Grondin, Legal Services is an organization that values your privacy and the protection of your personal information.

The purpose of this Privacy Policy is to inform you of our practices regarding the collection, use, processing, disclosure, retention and destruction of your personal information.

In the course of our legal business, we collect, use and process information for the purposes of providing legal services. Confidentiality is paramount to us, as is respect for the professional secrecy to which we are subject. We adhere to the highest ethical standards when handling all information, especially personal information.

By providing us with personal information (through our website www.sglavocat.com, by e-mail, in person or by telephone), you agree to its processing in accordance with this policy, and you authorize Samuel Grondin, Legal Services and its service providers to process your personal information for the purposes set out below.

1. Who are we?
Samuel Grondin, Legal Services is a boutique dispute resolution firm operating in English, French and Spanish for clients in Quebec, Canada and internationally.  

Our firm is directly responsible for handling your personal information in accordance with current legislation and regulatory standards applicable to our profession. 

2. What personal information do we collect?
We may collect and process various types of personal information in the course of carrying out our services and activities, including :
- Contact information, such as name, postal address, e-mail address and telephone number;
- billing and financial information and details of the services we have provided to you;
- information provided by or on behalf of our customers which may, where relevant, include sensitive personal information;
- identification and other background check data, such as a copy of a driver's license, proof of ownership or information on the source of funds, required to comply with anti-money laundering laws;
- recruitment-related information such as curriculum vitae, educational and professional background, and other information relevant to the recruitment of Samuel Grondin, Legal Services; and
- any other personal information provided. 

 

If you are a minor under the age of 14, please do not provide us with any personal information without the express consent of a parent or tutor. 

3. How do we collect your personal information?
We collect your personal information in several ways: 
- Directly in the course of providing legal services to you;
- By digital means (telephone, e-mail, fax, other);  
- When you subscribe to our newsletter via our website www.sglavocat.com;
- When you request information via our contact form on our website www.sglavocat.com;
 

4. How do we use your personal information?
Your personal information will be used in accordance with applicable privacy legislation and in accordance with your consent. 


We may therefore use your personal information in the following circumstances and for the purposes indicated, in accordance with the framework defined above:
- To provide our legal and related services and for the conduct of our business generally, to administer and perform our services, including to fulfill our obligations under any agreements entered into between our customers and us. 
- To respond to inquiries from visitors to our website www.sglavocat.com. 
- For marketing and business development purposes - to provide details of new services, to receive our legal newsletter and invitations to conferences and events where an individual has opted to receive such communications. You may withdraw your consent at any time.
- Recruitment purposes - to enable us to process job applications and assess whether an individual meets the requirements of the position for which he or she may be applying at Samuel Grondin, Legal Services.
- To satisfy and comply with legal, regulatory or risk management obligations. 
- To collect unpaid invoices owed to us and, if necessary, to use debt collection agencies or other legal means.  
 

5. With whom do we share personal information?
In addition to our employees, we may share your personal information with certain third parties, including the following:
- third-party service providers and/or partners who provide us with website services, administrative support, maintenance and other services. These third parties may access or process personal information in connection with the services they provide to us. We limit the information we provide to these service providers to that which is reasonably necessary for them to perform their functions, and our written contracts with these service providers require them to take reasonable and lawful measures to maintain the confidentiality of such information;
- governmental, regulatory or law enforcement agencies, if we are required to disclose such information or if we believe in good faith that such disclosure is necessary to comply with applicable laws;
- our professional advisors, bankers and auditors;

6. How long do we keep personal information?
We will retain your personal information for the duration of the mandate and for the fulfillment of the purposes for which it was provided to us, and for any authorized related purposes.

We will stop using your personal information as soon as these purposes have been fulfilled. 

In accordance with regulatory requirements, we are required to retain customer files for a period of seven (7) years from the date of closure, subject to instructions to the contrary.

7. Where do we store personal information and international transfers?
Your personal information is stored on our servers and/or those of our IT service provider. 

However, your personal information may be shared with service providers whose facilities are located outside Quebec. By doing business with our firm, you consent to the transfer of your personal information to countries or provinces (other than the Province of Quebec) where privacy rules may be different. However, we ensure that such suppliers provide adequate protection in accordance with generally accepted privacy principles by conducting a privacy impact assessment and having such suppliers sign a written agreement to this effect.

8. How do we protect personal information?
We recognize that information security is an integral part of privacy.

We use industry best practices to ensure that personal information is protected in accordance with applicable privacy legislation. 

To this end, we maintain reasonable physical, technical or procedural safeguards to protect your personal information from unauthorized access, use, modification, disclosure and/or destruction contrary to applicable legislation. 

All members of Samuel Grondin, Legal Services and third-party suppliers whose services we may retain and who process personal information on our behalf are also bound by contract to respect the confidentiality of personal information.

9. What rights does an individual have with respect to his or her personal information?

 

9.1 Rights of access, rectification and withdrawal of consent
To access your personal information, to request a correction to your personal information or to withdraw your consent to the disclosure or use of your personal information, you must send a written request to the Privacy Officer of Samuel Grondin, Legal Services (contact information can be found at the end of this Policy). 

The request for rectification must be particularly precise and correctly identify you in order to allow Samuel Grondin, Legal Services to correct or adequately complete the personal information deemed inaccurate or incomplete.

Please note that a request to withdraw consent will result in the termination of legal services by Samuel Grondin, Legal Services for the benefit of the individual concerned. 
 

9.2 Processing of requests
Samuel Grondin, Legal Services will normally respond to requests for access, rectification or withdrawal of consent within 30 days in accordance with the time limits prescribed by the Act respecting the protection of personal information in the private sector.

All necessary assistance will be reasonably provided to data subjects who wish to access or rectify their personal information, including clarification of exactly what they are seeking.


Depending on the amount of information requested in an access request, a nominal fee may be reasonably charged to cover the costs of responding to the request.

Written notification will be provided if Samuel Grondin, Legal Services must deny an individual access to his or her personal information for legal, regulatory or other reasons.
